Child Custody
In any child custody dispute, the family law court will look closely at the details to decide on the best custody arrangement for the children. The term custody refers to more than just living arrangements. It also covers elements such as health, education, welfare, religion and others.
There are a few different types of child custody arrangements, and we will help you decide which one makes the most sense for you and your children. They include:
- Sole Custody (decision-making)– One parent makes the major decision in the children’s lives and the non-custodial parent has the right to get information or inquire about the health and welfare of the kids.
- Joint Custody (decision-making) – Both parents share in the decision-making, and must be able to communicate maturely and cooperate in the best interest of the children. The children may primarily live with one parent or live with both parents equally.
- Shared Custody (decision-making)– This is a form of joint custody where children spend at least 40% of their time with each parent.
- Split Custody (decision-making)– This is when one parent has sole custody of one or more children and the other parent has sole custody of the other children. This type of custody is uncommon and usually only happens when the children are older.
In most situations, a judge will not break an agreement made by both parents regarding child custody. Unfortunately, in many circumstances, the parents cannot come to an agreement on their own and this is where the courts will need to decide what is in the best interest of the child. If this is your situation you will need a family lawyer to professionally represent you in court.
